Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

Consumer: A natural person purchasing products for personal, non-commercial use.

Withdrawal Period: 14 days in accordance with EU consumer protection laws.

Company: Avorila™, operated by MODPORT CLOTHING LTD.

Distance Contract: A contract concluded exclusively via the online store.

Durable Medium: Any medium allowing the consumer to store information permanently (e.g. email).

Article 3 – Scope of Application

These Terms & Conditions apply to all offers, orders, and contracts concluded via the Avorila™ online store.
By placing an order, the consumer agrees to these Terms & Conditions.

Article 4 – Product Offers

Products are presented accurately, transparently, and truthfully.
Obvious typographical, textual, or pricing errors are not binding.
All prices include applicable taxes, unless stated otherwise.

Article 5 – Conclusion of Contract

A contract is concluded once the customer receives an order confirmation by email.
Payments are processed securely via third-party payment providers, including:

PayPal

Mollie

Shopify Payments

Article 6 – Right of Withdrawal (14 Days)

Consumers have the right to withdraw from the contract within 14 days of receiving the goods.

Where possible, returned goods must be in their original condition.

Article 7 – Costs and Refunds in Case of Withdrawal

Return shipping costs are borne by the customer.

Refunds will be issued within 14 days after receipt and inspection of the returned goods.

Any loss in value resulting from excessive use may be deducted from the refund, in accordance with applicable consumer laws.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to:

Opened hygiene-related products

Custom-made or personalized products

Products that cannot be returned for hygiene or health protection reasons

Article 9 – Prices

Prices cannot be changed retroactively after purchase.
Obvious pricing errors are not binding and may result in order cancellation.

Article 10 – Warranty & Complaints

All products meet the quality standards described on the website.
Any defects must be reported within 2 months of discovery.

Warranty does not apply to:

Normal wear and tear

Damage caused by improper use

Damage occurring after delivery

Article 11 – Delivery

Estimated delivery time: 7–12 days.

In case of delays exceeding 60 days, the customer may cancel the contract free of charge.

Risk transfers to the customer upon delivery of the goods.

Article 12 – Subscriptions & Ongoing Contracts

Avorila™ does not offer subscriptions or automatic renewals.
If recurring services are offered in the future, the cancellation period will not exceed 1 month.

Article 13 – Payment

Payments are processed via:

Mollie

Shopify Payments

Customers are responsible for providing accurate and complete payment information.

Article 15 – Governing Law & Jurisdiction

If the customer resides in Germany or the EU, German law shall apply.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

For customers outside the EU, mandatory local consumer protection laws remain unaffected.

Article 16 – Additional Provisions

Any additional agreements must comply with applicable laws and may not disadvantage the consumer.

Article 17 – Data Protection & WhatsApp Communication

Avorila™ may use WhatsApp for customer communication.
WhatsApp processes phone numbers and may share data with Meta in accordance with its own privacy policy.

Customers may choose alternative communication channels at any time (email or phone).

Article 18 – Limitation of Liability

Avorila™ is not liable for:

Technical malfunctions

Typographical or display errors

Payment provider outages

Damages caused by incorrect information provided by the customer
